Bombay HC Refuses Interim Relief to Trimurti Films in ‘Saat Samundar Paar’ Remix Copyright Row

The Bombay High Court has refused to grant urgent interim relief to Trimurti Films Pvt Ltd in its copyright infringement suit against Dharma Productions, Saregama India Ltd, and rapper Badshah over the remix of the song Saat Samundar Paar in the film Tu Meri Main Tera Tu Meri.

The Court held that Trimurti failed to show that the 1990 assignment agreement conferred only limited rights, noting that it prima facie appeared to assign all rights in the musical and literary works.

Observing that the balance of convenience favoured the defendants due to substantial investment in the cinematograph film, the Court refused to restrain its release scheduled for December 25.
