
The Bombay High Court has restrained FedEx Securities Pvt Ltd and its group entities from using the mark “FEDEX”, holding that it infringes and dilutes the well-known trademark of Federal Express Corporation.
Justice R.I. Chagla ruled that once “FEDEX” was recognised as a well-known mark under the Trade Marks Act, 1999, its continued use by unrelated entities, even in financial services, could not be permitted.
The Court rejected the defence of long-standing use and granted an interim injunction, allowing a six-week window for compliance.
