Bombay High Court Grants Interim Relief to Marico in Parachute Hair Oil Trademark Infringement Case

The Bombay High Court has granted interim relief to Marico Limited, restraining Zee Hygiene Products from using packaging, trade dress, and labels deceptively similar to Marico’s “Parachute” hair oil range.

Justice Sharmila Deshmukh held that Zee’s Cocoplus product mimicked key visual elements like the flag, coconut tree, and broken coconut symbol.

The Court found Zee was not using its registered Cocoplus mark but a deceptively similar variant. Zee’s argument of prior independent use since 2005 was rejected.

The Court rejected Zee’s argument that the copied elements were generic and stressed that trademark infringement is based on an overall visual impression. A four-week stay was granted to enable Zee to appeal.
