Arrest After Sunset Violates Article 21: Bombay High Court Grants Bail to Woman Bank CEO

The Bombay High Court (Nagpur bench) granted bail to a woman arrested after sunset, stating her arrest violated Article 21 of the Constitution. Justice Urmila Joshi-Phalke said even suspects cannot be denied the right to life and liberty.

The woman, accused of sanctioning illegal loans as a bank CEO, was arrested without following due process. 

The Court noted the arrest happened after sunset, no written grounds were provided, and her relatives weren’t properly informed. The court ruled the arrest illegal and granted her bail. (Sujata Vilas Mahajan v State of Maharashtra)
