Elderly Parents Can Evict Son & Daughter-in-Law Despite Ongoing Matrimonial Disputes: Bombay High Court

  • Case Name: Chandiram Anandram Hemnani v. Senior Citizens Appellate Tribunal

The Bombay High Court rules that elderly parents cannot be forced to let their son and daughter-in-law stay in their self-owned house against their wishes. 

The couple was initially permitted to reside in the property out of goodwill, but relations later soured due to divorce, domestic violence, and criminal proceedings. The parents approached the Senior Citizens Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking eviction.

The court observed that temporary permission to reside does not confer a legal right, especially after relations turned hostile

The court ordered the couple to vacate within 30 days and pay ₹20,000 monthly arrears.
