Bombay High Court Rules Senior Citizens Act Doesn't Apply to Property Disputes

The Bombay High Court set aside the tribunal’s order, ruling that the Senior Citizens Act, 2007 cannot be invoked by one senior citizen against another for property possession.

The case involved two elderly sisters fighting over a slum house's first floor. The tribunal, relying on Section 23 of the Senior Citizens Act, 2007, ordered one sister's eviction. However, she argued that this was a civil property dispute, not a case of neglect or maintenance.

The High Court held that the tribunal had no authority to decide property ownership issues. Property disputes should be settled in a civil court, not under the Senior Citizens Act, 2007, and therefore overturned the tribunal's order.
