The Bombay High Court held that children under legal guardianship are entitled to be treated as dependents for club membership purposes.
The case involved the Bombay Presidency Golf Club cancelling memberships granted to two minors under their maternal aunt’s guardianship, despite full disclosure and submission of legal documents.
The Court held the cancellation as “manifestly illegal and perverse,” pointing out the club's rules did not differentiate between biological, adopted, or legally-guarded children.
The court also observed that the club had, in past cases, granted memberships to wards under guardianship. The Court directed reinstatement of the memberships, subject to standard age and marital conditions.
