Bombay High Court Seeks Compliance Reports on 'Two-Finger Test' Ban from Maharashtra Government and MUHS

  • Case Name: Smita Singalkar vs Maharashtra University of Health Sciences

The Bombay High Court directed the Maharashtra Government and the Maharashtra University of Health Sciences (MUHS) to submit reports showing compliance with Supreme Court guidelines banning the 'two-finger test' in medical examinations of sexual assault survivors.

The PIL, filed by Adv Smita Singalkar, termed the test as invasive, unscientific, and a violation of a survivor’s right to privacy.

In State of Jharkhand vs. Shailendra Kumar Rai, the SC had mandated all states to update medical curricula and train health professionals against using such tests.

The Court was informed that Maharashtra updated its MBBS syllabus in 2022, declaring virginity tests discriminatory and teaching students to explain their unscientific nature. The hearing will continue on April 9, 2025.
