Bombay High Court Sets Aside Fraudulent Gift Deed Executed by Son Over Mother’s Ancestral Property

The Bombay High Court recently set aside a fraudulent gift deed executed by a son in relation to ancestral property belonging to his mother.

The Court found that the son had obtained the deed through misrepresentation and subsequently transferred the property to his wife.

Observing that family relationships cannot be exploited to deprive a person of property rights unlawfully, the Court held the transaction invalid and legally unsustainable. 

It further noted that such conduct amounts to abuse of trust and misuse of legal processes. Accordingly, the Court cancelled the impugned transfers and imposed penalties/costs on the son for the fraudulent transaction.
