
The Bombay High Court upheld ₹62.2 lakh compensation awarded to the family of Charu Khandal, a 28-year-old employee at Red Chillies Entertainment owned by actor Shahrukh Khan, who sustained severe spinal injuries in a 2012 Mumbai road accident and died in 2017.
The court termed the case a tragic saga and ruled that fair compensation is essential under the Motor Vehicles Act, which protects dignity under Article 21.
The insurer’s claim that she did not die due to the accident, but she died nearly five years after the said accident, was rejected.
The Court noted that legal precision in medical bills isn’t required in cases involving prolonged human suffering.
