Bombay High Court Upholds Rules On Civil Services Attempts For Persons With Disability

The Bombay High Court has dismissed a petition challenging Rule 3 of the Civil Services Examination Rules 2024 which grants Persons with Benchmark Disability under the General/Economically Weaker Section/Other Backward Classes category- 9 attempts, while unlimited attempts to SC/ST category.

The petitioner argued that the classification between SC/ST and OBC is discriminatory and the court noted that the reservation to PwBD under the Persons with Disabilities Act, 2016 is a ‘horizontal reservation’ and to SC/ST and OBC under the constitution is a ‘vertical reservation’.

The court observed that in the PwBD category, a candidate belonging to the SC/ST category stands different footing than the OBC category and thus dismissed the petition.
