Supreme Court: Tribunals Can Order Eviction of Children Under Senior Citizens Act

The Supreme Court has held that the Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, has the authority to direct the eviction of a child from the property of the senior citizen parent if there is a breach of the obligation to maintain such senior citizen parent.

The Court allowed the appeal of an elderly couple while setting aside the Bombay High Court's order, which invalidated the eviction order passed against their eldest son.

The Bench stressed that the Act aims to protect senior citizens’ welfare and must be applied to ensure their dignity and care.
