Calcutta HC Orders Wife to Pay ₹1 Lakh for Defaming Husband with False Remarriage Allegation

The Calcutta High Court directed a woman to pay ₹1 lakh to her husband for defamation. 

The woman had published two newspaper notices in The Daily Telegram, falsely accusing her husband of attempting to remarry after his divorce plea was rejected.

The court noted that the woman failed to provide evidence or identify the alleged second wife.

The Court emphasized that such baseless public accusations can cause emotional distress and tarnish the husband's reputation.

Emphasising the right to dignity under Article 21, the Court highlighted that damages under tort law serve as a societal deterrent against baseless public accusations.
