Calcutta High Court Quashes Criminal Case Against Audi India Officials for Car's Brake Fail

  • Case Name: Joe King, Head, Audi India & Anr v Patton International Limited

The Calcutta High Court quashed criminal proceedings against senior Audi India officials over an alleged brake failure in an Audi Q5 on the highway.

The case was based on a 2015 complaint by Patton International Limited, accusing the Audi officials of cheating and fraud under IPC Sections 34, 120B, 418, and 420.

The Court ruled that Audi’s chief and customer service head could not be personally held liable.

Calling the allegations “inherently improbable” and a “gross abuse” of legal process, the Court said the complaint was filed with malice to turn a consumer grievance into a criminal case.
