
The Calcutta HC has quashed the summoning order against Microsoft Global Services Centre (India) in a cheating case related to the sale of pirated Microsoft Office software on Amazon.
A metropolitan magistrate in Kolkata had issued the summons without following the mandatory procedure under Section 202 of CrPC, which requires an inquiry when the accused resides outside the magistrate’s jurisdiction.
The case arose from a complaint by D&I Taxcon Services Pvt. Ltd., which purchased Microsoft Office from Datacorp Software LLP via Amazon but later found it was a pirated version.
The court ruled that Microsoft had no connection with the seller, leading to the quashing of the order.
