
The Himachal Pradesh High Court held that staff shortage cannot justify the denial of resignation or NOC to a medical professional seeking higher studies.
The petitioner, serving as Assistant Professor, had secured admission to a DNB-SS-Cardiology course via NEET but faced inaction from authorities on his NOC request. He had assured the State he would serve as a Super Specialist for five years post-completion.
Citing Dr. Trilok Chand and Ajay Kumar Chauhan's cases, the Court emphasised the right to career progression and directed the authorities to issue the NOC and grant extraordinary leave promptly. (Sanjay Kumar v. State of HP & Ors)
