CAT Sets Aside Transfer Of IRS Officer Sameer Wankhede in Aryan Khan Drug Case

  • Case Name: Sameer Dnyandev Wankhede v. Union of India

The Central Administrative Tribunal(CAT) set aside the transfer (Mumbai to Chennai) of Indian Revenue Service (IRS) officer Sameer Wankhede, who led an investigation into the Aryan Khan drug case.

The CAT found the transfer is “arbitrary and violative of transfer policy.”

The Central Board of Indirect Taxes transferred Wankhede in May 2022 and CAT noted that his deputation period should have been excluded while determining his tenure, an unjustified transfer. 

The tribunal stated, “There is no disagreement that the officer has All India Liability to serve, the respondents must ensure the postings of officers carried in a fair, transparent and just manner as per their own policy.”
