Challenge to Places of Worship Act, 1947 - Ongoing Debate

  • Case Name: Ashwini Kumar Upadhyay vs. Union of India

The Places of Worship (Special Provisions) Act, 1991 is being challenged. This Act states that the status of any place of worship should remain the same as it was on August 15, 1947. 

Petitioners argue that the Act takes away judicial review, which is a fundamental principle of the Constitution. They also claim the Act violates secularism, as it gives preference to one religion.

Section 3 of the Act, which criminalizes the conversion of places of worship, and Section 4,  which prohibits court intervention, are seen as unconstitutional.

The Supreme Court is still waiting for a response from the government and will listen to both sides on December 10.
