AI giants OpenAI, Google, and X.AI are facing trademark hurdles in India for ChatGPT, Gemini, and Grok, respectively. India’s use-based trademark system and crowded Class 9 category have triggered objections.
OpenAI’s ChatGPT faces opposition from Bengaluru’s Flaxxi AI, claiming prior use in education. X.AI's Grok was provisionally refused because of a similar mark, "Groke," registered by Finland-based Groke Technologies for marine navigation software.
Google's Gemini application was objected to due to Sun TV's existing "Gemini TV" trademark. These issues highlight the complexities of India's trademark laws, where local prior use can outweigh international recognition.
Interestingly, Anthropic’s Claude and Perplexity AI cleared trademark registration in Class 9 without opposition.
