Sexual Intercourse with a Dead Body Does Not Qualify as Rape : Chhattisgarh High Court

In a case involving the kidnapping, rape, and murder of a minor, one of the accused engaged in sexual intercourse with the victim's dead body.

The Chhattisgarh HC held that necrophilia does not amount to rape under Section 376 of the IPC or the POCSO Act, as these provisions apply only to living victims. The Court upheld the conviction for other offences under Section 201 and Section 34 of IPC, sentencing and the accused to seven years.

The other accused was sentenced to life imprisonment for rape, kidnapping, and murder under the IPC and POCSO Act.
