Children Must Maintain Aged Parents Even If They Receive Financial Aid: Kerala High Court

The Kerala High Court ruled that children must provide maintenance to their aged parents, even if the parents receive financial aid from friends or relatives to support themselves.

The Court emphasized that filial duty is a moral, religious, and legal obligation. The case involved a 74-year-old father seeking maintenance from his sons settled in Kuwait. 

The Family Court had denied maintenance, citing the petitioner’s alleged income. The High Court overturned this decision, citing laws like Section 4 of  the Maintenance and Welfare of Parents Act and CrPC Section 125.

It ordered the sons to pay ₹20,000 monthly, reaffirming a son’s duty to care for elderly parents.
