
The Supreme Court has ruled that an FIR lodged by an accused containing a confession cannot be used as evidence against them.
A bench of Justices JB Pardiwala and R Mahadevan held that such FIRs are barred by Section 25 of the Evidence Act.
The Court set aside Yadav’s conviction, stating the High Court erred by relying on his own confessional FIR. It also clarified that medical evidence alone can’t justify a conviction.
The ruling reaffirms that confessions to police are inadmissible unless covered under limited exceptions.
