
The Allahabad High Court clarified that even though confessional statements made to police cannot be included in a chargesheet, they can still be used during investigation.
Referring to the Supreme Court’s ruling in Sanuj Bansal v. State of U.P., the Court explained that such statements are inadmissible as evidence but can help the police in finding leads or discovering new facts.
The observation came while rejecting an anticipatory bail plea in a murder case, where the accused argued that he was implicated only based on a co-accused’s confession.
The Court held that investigation can rely on such material at the preliminary stage.
