Consent for Sexual Relations Does Not Give License to Share Private Videos on Social Media: Delhi HC

  • Case Name: Sudhir Kumar v. State NCT of Delhi
  • Judge(s): Justice Swarana Kanta Sharma

The Delhi High Court denied bail to a man accused of coercing and sexually exploiting a married woman by threatening to leak her private videos.

The Court ruled that consent for sexual relations does not mean consent to record or post private moments on social media.

The woman alleged that the accused blackmailed her into undressing during video calls and later forcibly established physical relations under threat.

The Court observed that even if the first sexual encounter was consensual, the subsequent acts involved clear coercion and blackmail.

The misuse of financial assistance to exploit the complainant further aggravated the offence.
