Court Appointed Experts say Delhi HC Has Jurisdiction in ANI vs OpenAI Copyright Case

The Delhi High Court-appointed experts, Arul George Scaria and Adarsh Ramanujan confirmed the court’s jurisdiction in ANI’s copyright lawsuit against OpenAI.

They stated that under the Indian Copyright Act, jurisdiction is based on the plaintiff’s (ANI) place of business, which is Delhi. OpenAI argued its servers are outside India, but the experts deemed this irrelevant.

The case centers on whether OpenAI’s use of ANI’s content for training AI constitutes copyright infringement or falls under fair use.

Key legal questions include storage of data, reproduction rights, and commercial use

. The court will also examine OpenAI’s “opt-out” policy and its impact on copyright.
