Court Issues Temporary Stay on Bikaner House

  • Case Name: Enviro Infra Engineers Pvt. Ltd. vs. Nokha Nagar Palika

The Patiala House Court stayed the attachment order for Bikaner House, which was mistakenly identified as the property of the Nagar Palika, Nokha. 

This attachment was initiated because the Nagar Palika of Nokha failed to pay ₹50.3 lakh to Enviro Infra Engineers Pvt Ltd for work on a sewage treatment plant.

The Rajasthan government argued that Bikaner House is state property, not owned by the Nagar Palika and should not be attached. Nagar Palika's counsel confirmed it does not own the property and intends to appeal the arbitration award.

Section 34 of the Arbitration Act was invoked by Nagar Palika to challenge the arbitral award, but their appeal was dismissed. The next hearing is scheduled for January 7, 2025.
