Messages Like ‘you are slim, smart, fair’ to Unknown Woman at Night Amount to Obscenity

A Sessions Court upheld the conviction of a man for sending obscene WhatsApp messages to a former corporator, stating that such messages amount to obscenity.

The court said that obscenity should be judged from the perspective of an “average person applying contemporary community standards". 

The court pointed out texts such as “you are slim, smart, you look fair” & “married or not?” sent to an unfamiliar woman at night amounts to modesty. 

The accused failed to prove any relationship with the woman. The court ruled that his actions violated the law, sentencing him to three months of imprisonment.
