Court Refuses to Quash Case Against Factory Manager Over Worker’s Death

The Bombay High Court declined to dismiss a case against Izhar Nizamulhak Khan, a factory manager at Shree Shakti Weldtech, following a worker’s fatal fall.

The bench heard the petition challenging charges under Section 304(A) of the Indian Penal Code (IPC).

The incident occurred on May 31, 2021, when welder Ilyas Sayyed fell while repairing the roof under Khan's instructions, despite lacking proper training. A faulty safety belt compounded the tragedy.

Rejecting arguments of double jeopardy under Article 20, the court held that the manager’s independent negligence warranted trial proceedings.
