Mere Crying Not Proof of Dowry Harassment, Delhi High Court Upholds Acquittal

The Delhi High Court upheld the discharge of a husband and his family in a dowry death and cruelty case, observing that the deceased’s crying alone does not establish dowry harassment.

Justice Neena Krishna noted that statements from the deceased’s siblings failed to show even a prima facie case of harassment for dowry demands.

Despite allegations of mental torture leading to death, the Court relied on the post-mortem report citing pneumonia as the cause.

The Court found no evidence supporting cruelty under Section 498A IPC and dismissed vague claims lacking specific incidents or proof of dowry demands, affirming the trial court’s decision.
