
The Saket District Court, Delhi, upheld the trademark rights of Carnatic Café and restrained Bengaluru-based Lemonpepper Hospitality Pvt. Ltd. from using the word “CARNATIC” for restaurant services.
The Court held that such use amounted to trademark infringement and passing off, given the identical trade name and nature of services. The Court issued a permanent injunction against the defendants, directing them to cease use of the mark and transfer the domain name www.carnaticrestaurant.com to the plaintiff within four weeks.
The Court also awarded damages of ₹50,000 and litigation costs of ₹10,000 to Carnatic Café.
