The Delhi court rejected an Army Major’s plea seeking CCTV footage and booking details of a hotel where his wife allegedly stayed with her lover, also an Army officer.
Civil Judge Vaibhav Pratap Singh held that the doctrine of “loss of consortium and alienation of affection” is outdated and inapplicable, noting the Supreme Court has struck down adultery as a criminal offence.
The Court emphasized that hotels must protect guest privacy and cannot be compelled to disclose information to third parties without legal entitlement.
The judge said the Major’s grievance was moral, not legal, and dismissed the plea.
