A Delhi court dismissed a plea seeking an FIR against the CEO and MD of Delhi Art Gallary (DAG) officials over the display of two allegedly “obscene” MF Husain paintings.
The complainant claimed the artworks offended religious sentiments.
Magistrate Sahil Monga ruled that the complainant already possessed evidence, including CCTV footage and the paintings, and further investigation was unnecessary.
The court cited Section 175(3) of the BNSS, which empowers a magistrate to direct police to register an FIR, should only be invoked judiciously and not where sufficient evidence is available to the complainant.
Notices have been issued to the proposed accused for further proceedings on February 12, 2025., allowing further examination of evidence.
