Trader Barred From Using “Goldey” Trademark Deceptively Similar To “Goldiee”: Delhi Commercial Court

A Delhi Commercial Court permanently restrained a Tripura-based trader from using the brand name “Goldey,” finding it deceptively similar to the registered trademark “Goldiee” of Shubham Goldiee Masale Pvt. Ltd.

The Court held that the marks were visually and phonetically alike, likely to mislead an average consumer.

The Court noted that even though the trader had not yet begun selling products, the act of applying for the trademark posed an imminent threat to the plaintiff’s brand.

Consequently, the Court issued a permanent injunction and directed the trader to pay ₹5 lakh as costs for non-appearance and lack of cooperation.
