The Delhi High Court sought the Union Government’s response on a petition challenging the cancellation of an Overseas Citizen of India card issued to an academic and the consequent bar on his entry into India.
The Court also issued notice on the petitioner’s request for interim relief and listed the matter for December 18. The petitioner argued that the revocation was arbitrary and prevented him from visiting family and continuing academic work in India.
He claimed entitlement to protection as a person of Indian origin under Article 12(4) of the International Covenant on Civil and Political Rights, which bars arbitrary deprivation of the right to return to one’s country.
