Delhi High Court Grants Custody to Father Over Territorial Risks Posed by Mother’s Foreign Nationality

A Division Bench dismissed the mother’s appeal against the family court’s earlier decision granting custody to the estranged husband.

The Court highlighted the mother’s strong foreign ties and limited roots in India, emphasising the importance of a stable upbringing within the Indian cultural context.

While granting custody to the father, the High Court ensured that the mother retains visitation rights, balancing the child’s welfare with parental access.
