Delhi High Court Upholds Influencers' Right to Criticize Brands in San Nutrition Case

The Delhi High Court upheld the right of social media influencers to criticize brands, affirming that evidence-backed criticism falls within free speech.

The case involved San Nutrition Pvt. Ltd., which sought to restrain four influencers from posting negative reviews about its product, DC Doctor’s Choice ISO PRO whey protein. The influencers cited discrepancies in the protein content, backed by NABL-accredited lab tests.

The Court ruled that reasonable criticism serves the public interest, allowing strong language like "ghatiya" and confirming no trademark infringement. 

This judgment sets a precedent for the boundaries of free speech in the digital age, balancing brand reputation with consumer rights.
