The Delhi High Court has upheld the Municipal Corporation of Delhi’s decision to use a Model Town plot as a playground for an adjoining MCD school instead of developing it as a public ornamental park.
Justice Mini Pushkarna said playground access is indispensable for children’s physical growth and overall development, stressing that sports are integral to education.
Dismissing the residents’ plea, the Court noted that a 100-acre Shalimar Garden park exists nearby, ensuring no loss of public space.
The Court held that MCD acted lawfully by aligning the layout plan with the land’s long-standing use as a school playground.
