Delhi High Court Orders Cancellation of 'Javapoint' Trademark Over 'JAVA' Infringement

  • Case Name: Oracle America, Inc. vs. Mr. Sandeep Khandelwal And Anr

The Delhi High Court ordered the cancellation of 'Javatpoint' trademark registration following Oracle America's plea.

Oracle, which has used the 'JAVA' trademark since the 1990s, argued that 'Javatpoint' was deceptively similar to its own marks, potentially confusing consumers.

Oracle provides JAVA training globally, including in India, overlapping with the services offered by 'Javatpoint.'

The court noted the absence of a reply from the defendant and concluded that the mark was adopted dishonestly to exploit Oracle's goodwill.

The court directed the Trade Marks Registry to remove the 'Javatpoint' trademark due to its violation of trademark laws.
