
The Delhi High Court held that a case cannot be transferred merely because a litigant claims bias without any real basis.
The Court observed that “hypersensitive” or vague apprehensions are not enough to seek transfer. It emphasised that there must be a reasonable and genuine ground, not just suspicion or discomfort with the judge.
Allowing transfers on such claims would lead to forum shopping and misuse of process.
The Court ultimately refused to transfer the case, reiterating that allegations of bias must be backed by credible material.
