The Delhi High Court has closed Nestlé India’s trademark infringement suit after Shankeshwar Utensils & Appliances Pvt. Ltd. undertook to discontinue the use of ‘Maggisun’.
Nestlé alleged that the use of ‘Maggisun’ for utensils infringed its well-known ‘Maggi’ trademark. During the hearing, the defendant agreed not to manufacture, sell, or advertise any products using the mark or any similar variation.
The company also consented to destroy existing stock and cancel its trademark registration. Recording the settlement, the Court decreed the matter accordingly.
