
The Delhi High Court held that ‘Complete Specification’ of a patent is sacrosanct in determining infringement.
The Court refused to grant an interim injunction to an agrochemical company that claimed others were copying its patent titled “Weedicidal Formulation and Method of Manufacture thereof.”
The Court noted that the company had clearly stated in its patent that a dye or colouring agent was an essential feature in its Complete Specification.
Since the defendants’ products did not contain any dye, the Court found no infringement. The case will be heard again on July 30.
