Delhi High Court Declares ‘Nutella’ a Well-Known Trademark

The Delhi High Court has declared "Nutella" a well-known trademark under Section 2(zg) of the Trade Marks Act and awarded ₹32 lakh in damages to its Italian parent company, Ferrero.

Justice Saurabh Banerjee ruled in favour of Ferrero in a trademark infringement suit against M.B. Enterprises, which was found manufacturing counterfeit hazelnut cocoa spreads using identical packaging and the 'Nutella' mark.

The Court noted Nutella’s international reputation and flagged the health risks of fake food products, especially for children.

The defendant was permanently restrained from further infringement, with ₹30 lakh awarded as damages and ₹2 lakh as costs.
