Delhi High Court Declares 'Peter England' as Well-Known Trademark

The Delhi High Court has declared an international menswear brand “Peter England” as a “well-known” trademark under Section 2(1)(zg) of the Trade Marks Act, 1999 and granted permanent injunction against its use.

The suit was filed by the brand’s parent company, Aditya Birla Group against Friends Inc. in regard to unauthorized use.

The Court noted that the brand has spent ₹31 crore on advertising and had a ₹1,289 crore turnover in 2023-24 with 380 outlets across 180 cities.

The Court upheld that brand has built a distinctive identity and has acquired secondary significance with respect to its goods and business, granting Aditya Birla exclusive rights as a single-source identifier of its products.
