Delhi High Grants ₹34.41 Lakh Damages to Bridgestone in Trademark Infringement Case by Indian Firm

  • Case Name: Bridgestone Corporation v. M/s Merlin Rubber & Anr.

The Delhi High Court issued a permanent injunction in favor of Japanese Company Bridgestone Corporation against trademark infringement by a similar business manufacturing tyres & tubes for automobiles under the ‘Brimestone’ mark.

The court noted that the defendant has taken unfair advantage of the reputation and goodwill amassed by the plaintiff’s ‘BRIDGESTONE’ tyres.

Justice Amit Bansal cited the case Koninlijke Philips N.V. & Anr. V. Amazestore & Ors. and held that "the court has to adopt a stringent approach where the infringement is deliberate and mala-fide” and awarded Rs. 34,41,240/- in favor of the plaintiff.
