Delhi HC Grants Permanent Injunction Against Paan Shop for Marlboro Trademark

The Delhi High Court granted a permanent injunction in favour of Philip Morris, restraining an Indian paan shop from infringing the trademarks and copyrights associated with "Marlboro" and the "Rooftop" symbol. 

Justice Amit Bansal found the paan shop guilty of selling counterfeit products using identical designs, misleading consumers, and unfairly leveraging Philip Morris's reputation.

The Court noted Philip Morris's ownership of the trademarks since 1924 and copyright over cigarette labels due to long-term use. The shop owner’s failure to contest the interim order led to the allegations being admitted, resulting in a permanent bar on infringing activities.
