
The Delhi High Court granted an interim injunction in favour of M/s Noor Ahmed Mohd. Azam, restraining the defendants from using the mark ‘NURY’ for spices.
The Court recognised the plaintiff’s continuous use of the registered trademark ‘NOORI’ since 1928 and its registration since 1998. The court found the defendants’ mark ‘SARDARJI MASALE WALE NURY’ deceptively similar and likely to cause consumer confusion.
The Court held that the adoption was dishonest and reaffirmed that word marks are strongly protected, ensuring brand identity is preserved regardless of font, style, or rebranding strategies. Further proceedings in the matter are ongoing.
