Delhi HC Issues Interim Relief in Trademark Dispute

Evergreen Sweet House filed a trademark infringement suit against JV Evergreen Sweets & Treats, claiming the latter’s name was confusingly similar. Both businesses sell sweets, use green branding, and are located near each other.

The plaintiff argued that the defendant’s name misled customers, and the defendant failed to justify using "Evergreen." The court found the defendant’s use of the mark deceptive and not in good faith.

The Delhi High Court granted interim relief, restraining the defendant from using "Evergreen." It also ordered the removal of the defendant’s listings from food delivery platforms and the takedown of their URLs and social media pages.
