
The Delhi High Court issued a notice to Dabur India Ltd. on Capital Foods’ plea alleging infringement of its registered trademark “Schezwan Chutney” under the Trade Marks Act, 1999.
Capital Foods claimed that Dabur’s packaging misleads consumers and violates its intellectual property rights, invoking Section 29 (infringement of registered trademark) and Section 31 (prima facie evidence of validity of trademark).
Dabur challenged the trademark under Section 57 (rectification of the register), arguing the mark is generic and descriptive.
The court listed the case for a February-end hearing, while Dabur’s cancellation plea will be heard on February 5.
