Attempt to Kill Wife in Domestic Violence Case Not Mitigated by Marriage : Delhi High Court

The Delhi High Court has ruled that offences of domestic violence where the intention is to kill must be treated with utmost seriousness, and marriage cannot be considered a mitigating factor.

Justice Swarana Kanta Sharma denied bail to a man accused of shooting his wife after she refused to live with him.

The Court said marital disobedience cannot justify violence, and treating it as provocation would only reinforce patriarchal entitlement.

The wife survived after multiple surgeries. The Court directed the trial court to finish proceedings within six months as the accused has been in custody for six years.
