
The Delhi High Court has ruled that if any part of a cognizable offence occurs within a police station’s jurisdiction, the local police must file a regular FIR under Section 154 CrPC, not a Zero FIR.
The Court noted that in the present case, one incident of alleged sexual assault occurred in Adarsh Nagar, Delhi, yet the local police mechanically transferred the complaint to Noida, Uttar Pradesh, undermining the gravity of the allegations.
This act not only delayed the investigation but also risked compromising crucial evidence.
The Court directed the Adarsh Nagar Police to register a regular FIR and conduct the investigation as per law.
